• Account Security: You are responsible for maintaining the confidentiality of your login credentials. Any activity occurring under your account is your sole responsibility. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription and Payments

• Service Plans: LivSync offers various subscription tiers. By subscribing, you agree to the recurring billing cycle associated with your chosen plan.
• Billing: All payments are processed through RBI-authorized third-party payment gateways.
• Taxes: All fees are inclusive of applicable GST unless stated otherwise.
• Cancellations: You may cancel your subscription at any time through the App settings or your respective App Store subscription manager.

5. Refund Policy

• Nature of Service: As LivSync provides immediate access to digital health tracking features upon purchase, payments are generally non-refundable.
• Disputed Charges: If you believe you have been charged in error, please contact support@livsync.in within 48 hours of the transaction. Refund decisions are at the sole discretion of Livness Health Care.

6. User Conduct and Restrictions

You agree NOT to:

• Input fraudulent, intentionally misleading, or “dummy” health data that could compromise the integrity of the platform.
• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Use the App to transmit viruses, malware, or any destructive code.
• Attempt to bypass any security measures or gain unauthorized access to other users’ data.

7. Language Policy

• Official Language: All official legal agreements, including these Terms of Use, are authored and executed strictly in English.
• Informational Translations: If you find this document translated into any other language (Malayalam, Hindi, Tamil), it is provided for informational and demonstrational purposes only.
• Legal Precedence: In the event of any conflict or discrepancy between the English version and a translated version, the English version shall be the sole legally binding authority.

8. Intellectual Property

All content, trademarks, logos, and software code within LivSync are the exclusive property of Livness Health Care. You are granted a limited, non-transferable, and revocable license to use the App for personal, non-commercial purposes only.

9. Limitation of Liability

To the maximum extent permitted by Indian law, Livness Health Care shall not be liable for any direct, indirect, incidental, or consequential damages resulting from:

• Your use or inability to use the App.
• Any inaccuracies in the health data logged or displayed due to user error or technical limitations.
• Any medical outcomes or health changes resulting from your use of the App.

10. Termination of Use

We reserve the right to suspend or terminate your account at our sole discretion, without notice, if we believe you have breached these Terms of Use or are engaging in activities that harm the App’s technical or legal integrity.

11. Governing Law and Jurisdiction

These terms are governed by the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in your Trivandrum, Kerala.
